GENERAL TERMS AND CONDITIONS OF SALE (GTC) FOR ORDERS MADE ON THE ONLINE STORE WWW.ORGANICA.SWISS.
The website www.organica.swiss is an online shopping service of the company SwissOrganica Sàrl (hereafter « SwissOrganica » or « We ») for customers in Switzerland.
The business relationship between SwissOrganica and you (the customer) is governed by the following conditions.
By ordering a product on the site, you acknowledge having read and fully accepted these General Terms and Conditions of Sale. SwissOrganica does not accept any divergent conditions on the part of the customer.

The products offered for sale by SwissOrganica are those shown on the website, on the day you consult the website, subject to stock availability. The photographs illustrating the products are not contractually binding.
In the event a product is unavailable, we will notify you by email as soon as possible of cancellation or partial delivery of your order.
You must meet the following requirements to place an order on this site:
– Be a natural person
– Be 18 or older on the day the order is placed
– Have the full legal capacity
When ordering via our online store, the ordering process includes 3 steps:
1. You choose the products you are interested in. You show this interest by clicking on the “add to cart” box. You may at any time continue your selection of articles, change your shopping cart or complete your order and pay the selection of products.
2. By clicking on the shopping cart icon, a summary of the order will then appear on the screen. If the list shown corresponds to the products you have chosen, you may continue your order by clicking on: “proceed to checkout”. You may identify yourself, either by entering your e-mail address and password, if you are already a customer or by accurately completing the form provided. You are informed and accept that entering any identification is proof of your identity and expresses your consent.
3. You enter the billing and delivery address and choose the payment method you want. At the end of this procedure, you can send us your order.
By placing the order, you agree to purchase the products you have selected in accordance with these Terms and Conditions.
CONFIRMATION OF THE ORDER
When you confirm your payment, a summary of the order will be sent to you electronically, to the e-mail address entered at the time of identification, before placing the order. If an ordered product is not available, you will be informed.
The recorded data constitute irrefutable proof of the order or the transaction made. All data recorded by the financial system constitute irrefutable proof of financial transactions.
SwissOrganica reserves the right to refuse an order, especially in the event of a subsequent refusal of the method of payment. Also, SwissOrganica reserves the right to sell the products to other customers able to pay the order if the payment pending is not settled in time (in case of tense stocks).
Applicable prices are those appearing on the site when you place your order.
Product shipping fees will be added to the total order price and specified in the order summary or email confirmation.
SwissOrganica reserves the right to modify prices at any time and without prior notice.
The payment of the products is made according to your choice, according to the means of payment proposed during the procedure of order and the conditions which are mentioned there.
In principle, we offer the following payment methods: payment by bank transfer, credit card (VISA and MasterCard), debit card (PostFinance Card) and TWINT. Currency exchange fees and bank charges may apply to purchases made with a credit card connected to a bank account located outside the Eurozone. The customer is solely responsible for the payment of such fees and charges.
For each order, SwissOrganica reserves the right not to offer certain types of payment and to refer to other payment methods.
Products will be delivered to the address indicated on the order confirmation within 3 to 6 business days from the date of order.
Standard deliveries to addresses of customers domiciled in Switzerland are free of shipping charges.
RIGHT OF RETURN
For all purchases on www.organica.swiss, SwissOrganica grants you a right of return for a total of ten (10) working days from the date of delivery of the order.
Products must be returned in their original packaging, intact and unopened.
The invoice must be included as well. Using a traceable shipping method, send the package to the following address: SwissOrganica Sàrl, Chemin de Pierrefleur 23A, 1004 Lausanne – Switzerland.
The costs of returning the products are your responsibility unless otherwise agreed.
If the above conditions are met, we will refund the full amount paid. In case of bank transfer, we will refund you on the account you have indicated for the refund. If you paid with a credit card, the refund will be made to your credit card. We may refuse the refund until we have received the return of the products or until you have provided the proof that you returned the products.
DAMAGED OR MISTAKEN SHIPMENT
It is the customer’s responsibility to check the quantity and condition of the goods at the delivery. In case of error (damaged or mistaken shipment) please contact us by email (email@example.com) within five (5) days of receiving the order. Any complaints made after this time limit will be rejected and SwissOrganica will be released of all liability.
After notifying us within the aforementioned time limit, please return the items including the invoice to us in accordance with the conditions of the article “Right of return” and within five (5) days from the date of the complaint.
SwissOrganica will replace the damaged product or the incorrect product with the one selected at the time of your purchase if the error is confirmed by its own services.
In case of unavailability of the ordered product, you will be informed.
ORDER CANCELLATION OR CHANGES TO ORDERS
Our system may cancel orders for a variety of reasons, including:
– Item unavailable
– Payment information cannot be processed
– The shipment could not be delivered to the address provided
– Duplicate orders
In such cases, you will be notified of the problem by email.
If you would like to cancel or make changes to your order, please contact us as quickly as possible by email: firstname.lastname@example.org.
SwissOrganica complies with all its legal warranty obligations, such as the legal guarantee of conformity provided for in Articles L211-4 et seq. of the Consumer Code and the guarantee for hidden defects provided for in Articles 1641 et seq. of the Civil Code. In case of lack of conformity or hidden defects of the product and in compliance with the conditions set by law, please send us your complaint by e-mail (email@example.com).
SwissOrganica reminds its customers that Organica100 products must be stored away from humidity, too high a temperature or too bright a light. In addition, the products are subject to an expiry date. Cosmetic products that have not been stored under the above conditions will therefore be excluded from the guarantee.
All content on the website, including text, graphics, photos, images, moving images, sound, illustrations, software, is our property. These contents are protected by copyright and other rights. Their use is only permitted with our express consent. Hypertext links to the site may only be created with the prior written consent of SwissOrganica.
All the brands used on the website are our brands. They are deposited and therefore protected. They may not be used without our prior written consent.
MODIFICATION OF THESE GENERAL TERMS AND CONDITIONS OF SALE
SwissOrganica reserves the right to update these General Terms and Conditions of Sale at any time by publishing a new version on this website. Any order placed after SwissOrganica has published the new version of its General Terms and Conditions of Sale shall constitute acceptance of the latter.
APPLICABLE LAW AND PLACE OF JURISDICTION
These General Terms and Conditions of Sale, as well as the sales of SwissOrganica’s products, are subject to Swiss law.
In the event of a dispute, the competent legal venue is Lausanne.
